What is a trademark?
A "trademark" is anything that is used to identify the goods or services of one company from the goods or services of another company. If you provide services instead of selling goods, your trademark is technically called a "servicemark." However, for the purposes of this website we refer to any “mark” as a trademark.

How do I obtain a trademark?
To obtain a trademark, you must file an application with the United States Patent and Trademark Office, which is operated by the United States government. 

After you file your trademark application, an attorney from the United States Patent and Trademark Office will review your application and determine whether or not your trademark may be registered.  Therefore, this is an application process. The United States Patent and Trademark Office could reject your application for several reasons.

After filing my trademark application, how long does it take for the United States Patent and Trademark Office to approve the application and grant my trademark status?
After filing your trademark application, it typically takes 3-8 months to receive a response from the United States Patent and Trademark Office. The response can be a notice that the trademark registration has been granted or denied, or it can be in the form of an “Office Action.”

An Office Action is the technical term the United States Patent and Trademark Office uses if it has a question or a comment on your trademark application. You must respond to an Office Action within six months or your trademark application will be considered abandoned.

Why should I register my trademark?
A trademark is a form of property – intellectual property.  It can be bought and sold or licensed. Therefore, after you obtain the registration for your trademark, it is a piece of property that you now own. This property can increase in value as you grow your business and build your brand.

In addition, if you are growing a business, you need a trademark to prevent someone else from selling products or services under your name and stealing business from you. After you register your trademark, you have the presumption of national ownership of that trademark.  You can therefore prevent others from using your trademark and sue for damages if someone infringes on your trademark.
