After you have collected the information, you can submit a trademark application electronically or by mail. The US Patent and Trademark Office will issue a serial number so you can track the status of your application. According to the agency’s Web site, the review process can take six months or longer. During that time, a USPTO attorney scours trademark databases and other sources to verify that no one else already uses your trademark. If USPTO finds a problem with your trademark application, it will notify you via an Office Action.
Your application will be successful if you answer all USPTO questions with satisfactory, timely answers, the USPTO attorneys don’t find any pre-existing uses of the trademark, and no one successfully challenges the trademark. To help pass all of those potential pitfalls, you should consider the services of a trademark attorney who can foresee potential problems in your application and help you resolve them before they arise.
