Types of Trademarks Available for Trademark Registration
When business owners are deciding on a name for a product or company, they should take into consideration whether or not the name they choose will be protectable as a trademark through trademark registration. Many business owners do not realize that certain names of products, services, or businesses are not protectable as a trademark.
The general principles of trademark law separate all trademarks into four categories:
The first type of trademarks, known as “descriptive” trademarks, are granted very little protection under trademark law until a business owner has spent five years or more advertising their product or services under their name. The remaining three categories all provide a business owner with some level of trademark protection, with arbitrary trademarks being those with the strongest and most enforceable trademark rights.
With the four types of trademarks in mind, you should choose a company or brand name wisely if you want to ensure that you can register a trademark. The United States Patent and Trademark Office has different standards for registering a trademark depending on the type of mark you seek. In general, fanciful and arbitrary trademarks are the easiest registered trademarks to obtain. On the other hand, descriptive trademarks receive approval less frequently. Suggestive trademarks fall in the middle of the continuum among registered trademarks.
